The Freezer Has Arrived & Case Dismissed

Just in time for the sweltering days of summer (when we aren't dripping from the constant rain), our freezer arrived.

I don't believe it will fit in the space I hoped would be it's home.  There doesn't appear to be enough clearance on all sides to facilitate proper air flow, so it will have a home around the corner. 
That is a minor inconvenience considering that we now have a place to store ice cream. 
"Around the corner" means in the fitness room open to the residents, guests, and others who roam the halls in the dark of night, 24/7.  So, that means figuring a way to secure it when the shop is closed. 
I suggested a lock, but shop and stock felt that a lock might compromise the warranty. 
He wants a band around it with a sturdy lock - I envision that as some sort of freezer chastity belt. 
I'm sure within the next few days a solution will come forth.
In the meantime, we are employing a leap of faith that no one will take off with our stash of ice cream.

On a happy note,this somewhat chilly day, my friend Chris who was arrested for making a phone call for no legitimate purpose can finally breathe a sigh of relief.

Chris' case was dismissed today. It was a long time coming, but all who know him, knew that it was a bogus charge.

Making a Phone Call For No Legitimate Purpose File


Remember reading about my friend, Chris?
Chris had a rather odd event at election time last year.
He found a political sign on his property for a candidate he did not endorse nor support.
Chris was upset that someone would place that sign and wrote a blog about it.  In his blog, he gave the person he suspected of placing the sign a humerous name. 
Within the next day or two, he found a new sign on his lawn that was autographed with that humerous name.
That person happens to be a Genesee Co. Legislator.  His contact information is easily found on the Genesee Co. website.  Chris called him and thanked him for reading his blog.
On election day, Chris was handcuffed and arrested for making a phone call with no legitimate purpose.

A Story in a Story

Things can get convoluted. 
A story breaks about a local guy who is running for Chris Lee's seat.  It is a story about a person who has values and backbone.  It has the drama of a 1930s detective film.  Back room politics at it's best.
Dave Bellavia is running against some pretty heavy hitters.  Hochul is a popular and capable woman who is the Erie County Clerk.  Corwin comes to the table ladened with family money and an agressive team of advisors who believe that negative ads are the way to go.
But, I'll let you read the stories yourself.

Making a Phone Call for No Legitimate Purpose Can Get You Arrested.

Charvella can start attending Genesee County Legislature meetings again.


Town of Batavia Justice Mike Cleveland today adjusted the order of protection barring him from showing up at the place of business of Legislator Jay Grasso.


Grasso has accused Charvella of harassing him for leaving a message on his home phone that said, "Thanks for reading my blog."


Charvella is charged with harassment, 2nd. Under the statute, he is accused of making a phone call with no legitimate purpose.
You better think twice about calling your local representative because the phone police will be knocking on your door.  While you may think your call had a purpose, that representative has the power to decide that it doesn't and get the law after you.  Kind of scary isn't it?  Not only that, but you can then be dragged through the court system for almost a year. 
Along with attorney E. Robert Fussell, Charvella, a Democratic committee member, appeared in Town of Batavia Court today for a status hearing.
Fussell indicated he is preparing motions to challenge the constitutionality of the charge, but the only request today was to change the order of protection issued in Town of Le Roy Court when Charvella was first arrested. The order prohibits Charvella from having any contact with Grasso.
"It's certainly has been my practice to attend meetings of the legislature," said Charvella, who ran for a seat on the county board in 2009. "That's a practice I would like to continue.
Assistant District Attorney Melissa Cianfrini object to the change in the order, saying that Charvella was offered a plea deal that would have altered the court order and given Charvella a conditional discharge of the case. Since Charvella turned down that offer and the case may go to trial, Cianfrini said, Charvella should be kept away in all circumstances from Grasso, since Grasso is both the alleged vicitm and a potential witness in any trial.
Grasso, a Republican, is Le Roy's elected representative on the legislature.
Outside of court, Fussell wouldn't confirm that he and his client intend to take the case to trial. He would only say, "I'm preparing motions." He said the motions would be based on constitutional issues.
During the hearing today, Fussell gave some indication of what those arguments will be, telling Cleveland, "If a politician doesn't like what a constituent has to say, it would be very, very chilling (to block meeting attendance). He (Charvella) should be allowed to attend these things."
Those motions must be filed by April 15 and Charvella's next court appearance was set for 4:30 p.m., May 23.

I've no doubt that Mr. Grasso and his attorney were sure that Chris would accept a plea deal in order to discharge this case.  Why should he?  There is a principle involved here, and yes, there are constitutional issues to be addressed.  I also think that Chris should face his accuser in court.  Isn't that what our judicial system is all about?  A plea deal, puleeze!

I'm glad that Chris can attend the legislator meetings.  He, as a citizen, has every right to observe and listen to what they have to say.  I hope that he also has the right to address them, if he wishes.

If you have a comment that you want brought to the attention of your elected officials, beware.  One might just decide that your comment doesn't fit the 'legitimate purpose' test and you may find yourself answering the door to a law enforcement agent. 

Mr. Fussell found the right word, "chilling".  It is chilling to think that one has to think twice before making that call.  It is "chilling" to think what the consequences might be.

Genesee Co. Industrial Development Agency, a Cesspool of Corruption?

Before I make a comment, take a look at the conclusions in the report that addresses the compensation awarded to those in charge of our Industrial Development efforts.

1. Prior to 2010, the GCIDA had no formal policies in place regarding bonus payments, but still had a practice of awarding bonuses to its employees. Any bonus program must be clearly defined in the adopted policies and procedures of the agency. The bonus payment practices followed by the GCIDA also do not comply with guidance provided in State Comptroller’s Opinion 2000-9 regarding provisions for additional compensation. The GCIDA’s current practices must be terminated and its bonus program suspended until such time as its policies conform to this guidance.



2. We recommend that all bonus payments provided to GCIDA employees during the period when it had no formal policies be recovered.


3. Bonuses may not be paid to individual employees based on the collective performance of the organization. Bonuses may only be paid in accordance with a performance evaluation program that pre-establishes clear and measurable goals that the qualifying employee must meet. The GCIDA bonus payment program should be based on individual performance standards that are specific and clearly differentiated from the normal job duties of the employees, and specify the amount of bonus payments to be received for meeting those identified standards prior to the services being provided. This program should be formally documented and described and formally approved and adopted by the board.


4. The bonus payment provided to the consultant in January 2009 is not provided for under the terms of the consultant agreement and is inappropriate. As a result, the board of the GCIDA should act to recover this $500 payment.


5. All bonus payments to be awarded should be formally presented and approved by the board prior to making payment by a compensation committee properly established in the by-laws of the GCIDA.


6. The board should re-evaluate the appropriateness of the executive director’s compensation package, given that he receives the highest salary of any county IDA executive director, and the total compensation he received in 2009, including the bonus, was nearly $100,000 more than any other public employee in Genesee County.
 
Of course, those in charge cried foul!  They feel that they should act as a private business even though they are 90% funded by Genesee Co. taxpayers.
 
Yet, this study showed that the executive director received, in part:
"For 2009, his salary was set at $153,000, with a three percent increase in 2010. In addition to a bonus, the executive director was originally provided with membership in a country club of his choice, and a $900 monthly allowance for automobile use. These benefits were dropped in the 2009 through 2011 employment agreement, and replaced with a life insurance policy and a deferred compensation plan."
A membership to a country club of his choice?  How many other county employees are given this perk?
The executive director's makes more than our Genesee Co. District Attorney.  He is one of the top paid IDA executives in New York State.  Folks, our county is so small, that most times everyone in NYS forgets we exist.  If he were bringing good paying jobs to Genesee Co., then perhaps all of this could be justified.  The sad fact is that his track record for bringing jobs is dismal.

Federal judge dead, congresswoman among 12 wounded in shooting

"(CNN) -- A federal judge was killed and a congresswoman gravely wounded Saturday in a shooting outside of a Tucson, Arizona, grocery store, according to police and government officials.


In all, six people died and 12 were wounded in the shooting, including U.S. Rep. Gabrielle Giffords, D-Arizona, according to Rick Kastigar, bureau chief for the Pima County Sheriff's Department.


President Barack Obama later said Chief Judge John Roll of the U.S. District Court for Arizona was among the dead.


A 9-year-old girl also died in the attack, according to authorities. The child, whose identity had not been released, was pronounced dead at a hospital....."

I have tried to put together words that made sense about the horrific act, but none come.
Once again, I turn to my good friend, Chris, who said everything I felt.

My very first blog (and the only one for a long time) was a guest editorial by my friend, Chris Charvella.
We are still working to save the nursing home. It has not been put on the back burner.
This summer and fall were busy working in The Snack Shop and helping to elect candidates for the fall elections.
It is ironic that my second entry is also about Chris. It is written by Adama Brown for The Albany Project.
It speaks for itself.

Ladies and gentlemen, I have a little story to tell you. It features fits of pique, Republican misbehavior, sock puppets, astroturf, abuse of authority, abuse of the legal system, and a paid employee of State Senator Ranzenhofer (R-SD61) who has engaged in all of the above and then some.
Seriously: this is worth reading the whole thing, if only for the extremely disturbing image of what BuffaloPundit sarcastically christened the "rape Ewok."

Adama D. Brown :: Let me tell you a story about abuse of power, upstate style.
The first character in our little story is Jerome Grasso, a Genesee County legislator (Republican, naturally) and a paid employee of State Senator Mike Ranzenhofer. Mr. Grasso is somewhat of a notorious figure in these parts: besides having somewhat shady financial history, last year Mr. Grasso achieved the sort of fame in political circles that you can usually only get by publicly lighting your own hair on fire.

After being tipped off by local Democrats, Genesee County news website The Batavian discovered that Mr. Grasso was engaging in sock puppetry on their website, having posted 14 messages in four weeks under the assumed name "Michael Barney." After initially denying it, and claiming that "Michael Barney" was a friend of his, Grasso admitted to the deception. A deception which, as it happens, he used to advocate on the site in favor of the county government's controversial ambulance plan, which Grasso had a stake in, as well as talking about "Jerome Grasso" as one of the younger and more tech-savvy members of the legislature.

The second character in this little narrative is Chris Charvella, a 30 year old father of one, former candidate for the County Legislature (though not against Grasso) and who besides his job with Batavia Restaurant Supply, is the campaign director for the Genesee County Democratic Committee.

Disclaimer: I know Chris personally in the context of his political involvement in a neighboring county. He hasn't talked to me about this matter at all.

Dateline:a few weeks ago. I'll let Chris' own blog entry describe the events of October 26th.
"A certain legislator from Genesee County, let's pretend his name is Sharome Glasshole, is also the Genesee County republican 'sign guy.' Yesterday when I got to work, there was a Mike Ranzenhofer sign in the lawn in front of the flower shop next door to my place of business. Most people don't know that the company I work for owns the flower shop property as well and the only person in the company who would authorize a political sign on either property would be...you guessed it, me.
Now, there's no way to be sure who put the sign there, but we can certainly make an educated guess or two.

So, to the Genesee County 'sign guy' and the Ranzenhofer campaign: The next time I see an unauthorized sign go up in front of a commercial property, I'm going to harvest the damn thing, march straight down to republican headquarters and cram it up the first ass I see. "

That is all.

But in fact, it wasn't. On election day, Chris stopped by his house and found a Ranzenhofer sign planted in his front yard. On it was written a personal message: "Courtesy of Sharome Glasshole."

This inspired Chris to blog again, noting that "Sharome Glasshole" was indeed a reference to Grasso, and then swinging for the fences:

"Now, once again I can't prove that it was Grasso who trespassed on my property in a silly effort to taunt me, but I can make an educated guess.
If it was, in fact, Mr. Grasso who trespassed and planted that sign in the yard that my daughter plays in, I'd like to ask a simple question:
Shouldn't a guy who spends most of his time in personal bankruptcy, a guy who can't seem to buy a house without being foreclosed on, a guy who holds elected office and claims to be a fiscal conservative spend more of his time paying attention to his own property or doing something useful, like getting a job and paying his bills? (Yes, of course I have the paperwork to back this up.)
'But wait!' you say, 'he has a job.' Of course it's a political patronage job that involves him being a paid sleazebag for Senator Mike Ranzenhofer. To top it off, while holding this job he had enough free time to fake an identity and discuss county business on a local news/blogsite.
He used to have another job as a Genesee County Sheriff's deputy. He left due to disability. Coincidentally, while a deputy, he was sued for brutality after he allegedly beat and pulled his weapon on a severely disabled man who had to pee. If you think I'm making that up, I have the court transcripts. Grasso beat the rap, but so did O.J. Simpson.
So, to Jerome Grasso, who may or may not have trespassed on my property today, enjoy your last year in the Legislature."

Chris also left a brief message on Grasso's answering machine: "Hey, Jerome, it's Chris Charvella. Thanks for reading my blog." Literally, that is the entire content of the message, as transcribed in the court records.

Court records? Yeah, we'll get to that in a minute.

Evidently, Grasso is one of those people who always has to have the last word no matter what, because in commentary to The Batavian, he described Chris' leaving that message on his answering machine as "calling my house and threatening my wife."

On those grounds, Grasso arranged to have a New York State Trooper come to Chris' house to talk to him about his "phone call."

Now, I seriously doubt they send out a State Trooper for every single unsolicited phone call--in fact, a friend of mine having been subjected some years back to dozen of harassing calls stretching over months, I know it's very difficult to get the police enough evidence to act unless there's a direct threat. At least, that's the case if you're an ordinary person and not either a county legislator or an employee of a New York State Senator.

Then, later that same day, they had the State Police come back and arrest Chris.

Let me repeat that, to make sure it's clear: they had the New York State Police come to Chris' house, and arrest him for saying mean things on the internet about a Republican. The official charge is "Aggravated Harassment in the Second Degree." According to the official jury instructions for that charge, emphasis mine:


[A] person is guilty of Aggravated Harassment in the Second Degree when, with intent to harass, annoy, threaten or alarm another person, he or she intentionally and repeatedly harasses another person by following such person in or about a public place or places or by engaging in a course of conduct or by repeatedly committing acts which places such person in reasonable fear of physical injury.
Despite the fact that this doesn't even come within catapult distance of that definition, Chris is now in court, having failed to win an immediate dismissal. Of course it must be noted that out here, not only is the DA a Republican, but the only sympathetic judge anywhere in the area is the one who had to recuse himself from the case, since Chris was involved in getting him elected.

Just for added irony, Chris--who spent six years in the United States Air Force, and was at that time one of the few dozen people on the planet qualified to do crash recovery and flight control work for U-2 spyplanes--was arrested on Veterans' Day.

So: now you can be arrested for saying rude things on the internet? I'm glad I know, since I'll now be able to sue pretty much the entire fucking internet. I can only conclude with the two sentence statement Chris issued to The Batavian: "You can decide whether or not there is something illegal in there. I obviously don't think so."
